1.2 Through the Website, Indian Holiday Pvt. Ltd. shall provide you ("User") travel-related information, pricing, and reservations for hotels, holiday packages, airlines, car rentals across India ("Services"), as more particularly described and defined in the terms of service ("TOS") relating to such Services. These Services may be availed by the User, his family members, relatives and friends in India at any time during the year through vendors ("Service Providers").

1.3 This User Agreement ("Agreement") elaborates the terms and conditions on which Indian Holiday Pvt. Ltd. shall provide the Services to the User through its website networks. In addition to this Agreement and depending on the Services opted for by the User, the User shall be required to read and accept the relevant TOS for such Service, which may be updated or modified from time to time by Indian Holiday Pvt. Ltd. Such TOS shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail.

1.4 Transaction on the Indian Holiday Websites network is offered to the User on condition of acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be posted on the Website from time to time. It is clarified that use of the Website (site network) by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. In case of disagreement with terms, conditions and notices or any part of the same, the User must not transact on the Website.

1.5 Additionally, the Service Provider may provide terms and guidelines that govern the service(s) offer or a particular feature of the same or the operating rules and policies applicable to each Service (for example: tour package, hotel reservations, flights etc.). 1.6 Indian Holiday Pvt. Ltd., at its sole discretion, Reserves the Right Not to Accept Any Order Placed by the User through the Website without assigning any Reason Thereof. Any Contract To Provide Any Service By Indian Holiday Pvt. Ltd. is Not Complete until Full Money towards the Service Is Received from the User and Accepted by Indian Holiday Pvt. Ltd.

Modification of Terms
1.7 Indian Holiday Pvt. Ltd. reserves the right to change the terms, conditions and notices under which the Services are offered through the Website, including but not limited to the charges for the Services provided through the Website. The User shall be responsible for regularly reviewing these terms and conditions.

Ltd. acts only as a booking agent, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the user as regards the standards of services provided by the service providers. In no circumstances shall Indian Holiday Pvt. Ltd. be liable for the services provided by the service provider.

1.12 Although Indian Holiday Pvt. Ltd. makes reasonable commercial efforts to ensure that the description and content in the TOS and on each page of the website is correct, it does not, however, take responsibility for changes that occurred due to human or data entry errors or for any loss or damages suffered by any user due to any information contained herein. Also, Indian Holiday Pvt. Ltd. is not the service provider and cannot therefore control or prevent changes in the published descriptions which are based upon information provided by the service providers.

1.13 Indian Holiday Pvt. Ltd. does not, by offering travel related services to particular destinations, represent or warrant that travel to such destinations is without risk, and shall not be liable for damages or losses that may result from travel to such destinations.

1.14 In no event shall Indian Holiday Pvt. Ltd. be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from: (A) the use or the inability to use the services; (B) the cost of procurement of substitute goods and services or resulting from any goods, information or services purchased or obtained or messages received or transactions entered into through the services; (C) unauthorized access to or alteration of the user's transmissions or data; (D) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the website.

Neither shall Indian Holiday Pvt. Ltd. be responsible for the delay or inability to use the website or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the website, or otherwise arising out of the use of the website, whether based on contract, tort, negligence, strict liability or otherwise. Further, Indian Holiday Pvt. (g) Download any file posted by another user of a Communication Service that the User know, or reasonably should know, cannot be legally distributed in such manner;

(h) falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;

(i) Violate any code of conduct or other guidelines, which may be applicable for or to any particular Communication Service;

(j) Violate any applicable laws or regulations for the time being in force in or outside India; and

(k) Violate any of the terms and conditions of this Agreement or any other terms and conditions for the use of the Website contained elsewhere herein.

1.16 Indian Holiday Pvt. Ltd. has no obligation to monitor the Communication Services. However, Indian Holiday Pvt. Ltd. reserves the right to review materials posted through Communication Service and to remove any materials in its sole discretion. Indian Holiday Pvt. Ltd. reserves the right to terminate the User's access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Fees Payment
1.17 Indian Holiday Pvt. Ltd. Reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the Indian Holiday Pvt. Ltd. Services. Indian Holiday Pvt. Ltd. further reserves the right to alter any and all fees from time to time, without notice.

The User shall be liable to pay all applicable charges, fees, duties, taxes, levies and assessments for availing the Indian Holiday Pvt. Ltd. Services.

1.18 Registration of the User on the Website is optional. If the User opts to register himself on the Website, upon completion of the registration process, the User shall receive a user id and password. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. Further, the User agrees not to use any other party's under id and password for any purpose whatsoever without proper authorization from such party.

1.19 User is responsible for the security of his password and for all transactions undertaken using the same through our service. The Password entered by the user is transmitted in one-way encrypted form to our database and stored as such. Thus the Password will not be known even to Indian Holiday Pvt. Ltd. User confirms that he is the authorized holder of the credit card or the original account used in the transactions on the Indian Holiday Pvt. Ltd. websites. Indian Holiday Pvt. Ltd. will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your ID/password/credit card number/account details number for using Indian Holiday Pvt. Ltd. Services.

1.20 The user also agrees and undertakes to immediately notify Indian Holiday Pvt. Ltd. of any unauthorized use of the user's password or user id and to ensure that the user logs off at the end of each session at the website. Indian Holiday Pvt. Ltd. shall not be responsible for any, direct or indirect, loss or damage arising out of the user's failure to comply with this requirement.

1.21 The User also agrees to:
(a) provide true, accurate and complete information about himself and his beneficiaries as prompted by the registration form ("Registration Data") on the Website, and

(b) Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provide any information that is untrue, inaccurate, not current or incomplete or Indian Holiday Pvt. Ltd. has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Indian Holiday Pvt. Ltd. has the right to suspend or terminate the User's registration and refuse any and all current or future use of the Website and/or any Service.

User's Obligations & User Account
1.22 In consideration of use of the Website, the User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from using the Website and/or receiving the Services under the laws of India or other applicable law.

1.23 Indian Holiday Pvt. Ltd. may at any time in its sole discretion reinstate suspended users. once the user have been indefinitely suspended the user may not register or attempt to register with Indian Holiday Pvt. Ltd. or use the website in any manner whatsoever until such time that the user is reinstated by Indian Holiday Pvt. Ltd. notwithstanding the foregoing, if the user breaches this agreement, the TOS or the documents it incorporates by reference, Indian Holiday Pvt. Ltd. reserves the right to recover any amounts due and owing by the user to Indian Holiday Pvt. Ltd. and/or the service provider and to take strict legal action as Indian Holiday Pvt. Ltd. deems necessary.

Termination of Agreement & Services
1.24 Either the User or Indian Holiday Pvt. Ltd. may terminate this Agreement and a Service with or without cause at any time to be effective immediately.

1.25 The User agrees that Indian Holiday Pvt. Ltd. may under certain circumstances and without prior notice, immediately terminates the User's user id and access to the Website/Services. Causes for termination may include, but shall not be limited to, breach by the User of this Agreement or the TOS, requests by enforcement or government agencies, requests by the User, non-payment of fees owed by the User in connection with the Services as specified in the applicable TOS.

1.26 This Agreement may be terminated by either the User or Indian Holiday Pvt. Ltd. through a written notice to the other. Indian Holiday Pvt. Ltd. shall not be liable to the User or any third party for termination of any Service. Should the User object to any terms and conditions of this Agreement, any TOS or become dissatisfied with the Service in any way, the User's only recourse is to, immediately:

a) Discontinue use of the Website/Service; and

b) Notify Indian Holiday Pvt. Ltd. of such discontinuance.

1.27 Upon termination of the Service, User's right to use the Website/Services and software shall immediately cease. The User shall have no right and Indian Holiday Pvt. Ltd. shall have no obligation thereafter to execute any of the User's uncompleted tasks or forward any unread or unsent messages to the User or any third party. Once the User's registration or the Services are terminated, cancelled or suspended, any data that the User has stored on the Website may not be retrieved later.

Payments Procedure

1.28 Online Card Payments Visa, Master and American express Card payments are processed through an online payment gateway system. You need not worry about your credit card information falling into the wrong hands because your bank will authorize the credit card transaction directly without any information passing through us. In approximately 25-30 seconds (depending on your Internet connection) your bank will issue, using the online payment gateway, an authorization code and confirmation of completion of transaction(s).

1.29 Security The payment gateway on www.Indianholiday.org, as a Verisign Certified interface provided HDFC Bank, uses the latest 128 bit encryption technology and other sophisticated methods to protect your credit card information. You can book your product using SSL encryption (the internet standard for secure transactions). In fact, transacting online with a credit card at the Website is even safer than using a credit card at a restaurant because we do not retain your credit card information. You can be assured that Indian Holiday Pvt. Ltd. offers you the highest standards of security currently available on the Internet so as to ensure that your transaction experience is private, safe and secure.

1.30 Payment Declination If the payment on the credit card is declined for some reason, alternate payment instructions must be received by Indian Holiday Pvt. Ltd. 72 hours prior to the time of departure; else, the order is liable to be cancelled.

1.31 Password You are responsible for the security of your password and for all transactions undertaken using your password through our service. The Password entered by you is transmitted in one- way encrypted form to our database and stored as such. Thus the Password will not be known even to Indian Holiday Pvt. Ltd. You confirm that you are the authorized holder of the credit card or the original account holder used in the transactions you make using the Indian Holiday Pvt. Ltd. services. Indian Holiday Pvt. Ltd. will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your ID/password/credit card number/account details number for using Indian Holiday Pvt. Ltd. Services.

1.32 Transaction confirmation You should not take any action based on information on the Website until you have received a confirmation of your transaction. In case of confirmations to be received by email, if you do not receive a confirmation of your purchase/transaction within the stipulated time period, first look into your "spam" or "junk" folder to verify that it has not been misdirected, and if still not found, please contact Indian Holiday Pvt. Ltd.

Clauses

1.33 INTERPRETATION OF NUMBER AND GENDERS The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine. The words "include", "includes" and "including" shall be deemed to be followed by the phrase "without limitation". Unless the context otherwise requires, the terms "herein", "hereof", "hereto", "hereunder" and words of similar import refer to this Agreement as a whole.

1.34 GOVERNING LAW this agreement and each TOS shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of New Delhi.

1.35 NOTICES

All notices and communications (including those related to changes in the TOS, Service, termination of Service etc.,) shall be in writing, in English and shall deemed given if delivered personally or by commercial messenger or courier service, or mailed by registered or certified mail (return receipt requested) or sent via email/facsimile (with acknowledgment of complete transmission) to the following address:

(a) If to Indian Holiday Pvt. Ltd. at [email protected]. or at the address posted on the Website.
(b) If to a non-registered User, at the communication and/or email address specified in the application form availing of a Service by Indian Holiday Pvt. Ltd.
(c) If to a registered User, at the communication and/or email address specified in the registration form.
(d) Notice shall be deemed to have been served 48 hours after it has been sent, dispatched, displayed, as the case may be, unless, where notice has been sent by email, it comes to the knowledge of the sending party, that the email address is invalid.

Terms & Conditions for Inbound and Domestic Tour

All correspondence(s) in respect of Tours / Travel Services and bookings should be addressed to M/s. Indian Holiday Pvt. Ltd.

Terms & Conditions for Inbound Tours

Booking:

On confirmation of booking your contract is with M/s Indian Holiday Pvt. Ltd. A contract exists between us when we confirm your tour/travel services and have received the deposit amount from your end. .

Payment:

For the services contracted, a minimum deposit of 25% of the total cost is to be paid by you to M/s Indian Holiday Pvt. Ltd. The deposit is required to hold the booking on confirmed basis.

Balance Payment:

Balance payment is to be made 15 days prior to the date of start of services. Any booking made within 15 working days of the date of services would be considered to be a late booking and for same the full and final payment is required to be made at the time of booking itself.

Note: Apart from above, in case of bookings for special train journeys, hotel or resort bookings during the peak season (X-Mas, New Year) full payment is required to be made at the time of booking itself.

Mode of Payment:

For Domestic and International clients

Domestic clients can make payment using any of the following methods:-

  • By Online Payment Gateway system through (American Express / Visa / Master Card / Discover / Diners Club).
  • By Debit Card verified by Master/ Visa / Maestro.
  • By Offline Credit Card Payment (American Express / Visa / Master Card / Discover / Diners Club).
  • By Cash / Cheque / Demand Draft.
  • By Bank Transfer (RTGS & NEFT).

International clients can make payment using any of the following methods:-

  • By Online Payment Gateway system through (American Express / Visa / Master Card / Discover / Diners Club).
  • By Debit Card verified by Master / Visa / Maestro.
  • By Offline Credit Card Payment (American Express / Visa / Master Card / Discover / Diners Club).
  • By Bank / Telex Transfer to our Bank A/c.

In case of payment through credit/ debit card, the bank charges (3% extra) - would be levied over and above the total amount.

    Note:
  • All payments should be free and clear of any withholding tax and deduction.
  • Bank charges, if any, for remittance (by remitting bank or by intermediary bank) would be strictly borne by payer.

Payments Procedure

All payments are to be made in name of M/s Indian Holiday Pvt. Ltd.

Policy Regarding Cancellation / NO SHOW / EARLY DEPARTURE :

In case of cancellation of tour/travel services due to any avoidable/unavoidable reason/s we must be informed in writing. Cancellation charges would be effective from the date we receive letter in writing and cancellation charges would be as follows :

  • 60 days & prior to arrival - 10% of the tour/service cost.
  • 59 days to 30 days prior to arrival - 20% of the tour/service cost.
  • 29 days to 15 days prior to arrival - 25% of the tour/service cost.
  • 14 days to 08 days prior to arrival - 50% of the tour/service cost.
  • 07 days & less, prior to arrival or no show - NO REFUND.

Please note -

1. Irrespective of above mentioned cancellations slabs - incase of cancellation of tour / travel services after the booking is made with us - a minimum 10% service charges would be applicable.

2. In case you cancel the trip after commencement refund would be restricted to a limited amount that too would depend on the amount that we would be able to recover from the hoteliers we patronize. For unused hotel accommodation, chartered transportation and missed meals etc. we do not bear any responsibility to refund.

3. In case of special train journey (like Palace on Wheels, Royal Rajasthan on Wheels, Deccan Odyssey, Golden Chariot, Indian Maharaja & Maharajas Express) - a separate cancellation policy is applicable (which would be advised as and when required).

4. For high peak season bookings (from 20th Dec to 15th Jan) - please note that if the booking for high peak season is/are cancelled, due to whatsoever reason, no refund would be made for said cancellation.

Refund

In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 - 4 weeks due to banking procedures. If the refund is made to the credit card account OR to Bank account, the bank charges would be debited from the refund amount.

Arrival and Departure Policy:

Check-In Timings: 1200 - 1500 Hours

Early arrival is subject to availability. For guaranteed early check-in, reservation needs to be made starting from the previous night.

Check-Out Timings: 1000 - 1200 Hours

Late check-outs are available on request and subject to availability / Payment

Extra Usage of Vehicle:

Please note that the cost of extra usage of vehicle (cars / coaches with the driver) is not included in the services and hence extra usage of Vehicle after transfer or after sightseeing is not allowed until unless it is mentioned in the detailed itinerary / services.

Our liabilities & limitations:

Please note that after the finalization of the tour/service cost, if there are any hikes in entrance fees of monuments/museums, taxes, fuel cost or guide charges by the Govt. of India, the same would be charged as extra.

Indian Holiday Pvt. Ltd. rates are based on the prevailing rates as negotiated by us with the hotels, airlines etc. Hotels and Airlines retain the right to modify the rates without notice. In case of such change - the rates quoted by us before modification can be changed by us according to the modifications by hotels or airlines.

Indian Holiday Pvt. Ltd. and its associates acts only in the capacity of an agent for the hotels, airlines, transporters, railways & the contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us - are issued subject to terms & conditions under which these services are provided by them. The tickets, coupons or passage contract in use by carrier / hotel or other contractors rendering services shall constitute the sole contract between the Clients and such contractor.

Indian Holiday Pvt. Ltd. - itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. Indian Holiday Pvt. Ltd. reserves the right to amend any aspect of the itinerary including transportation and accommodation without notice in the interest of the trip, participants' safety, comfort and general well being without making any rebate, allowance or refund and extra cost, if any, would be payable by the client.

Indian Holiday Pvt. Ltd. shall not be responsible for any delay or change in programme or expenses incurred or special / consequential loss, injury and damage - directly or indirectly - due to natural hazards, flight cancellations, accident, breakdown of machinery or equipments, breakdown of transport, weather, sickness, landslides, political closures, acts of God, perils incident to the sea, floods, fire, acts of Government or any other authorities, wars, civil disturbances, riots, theft, pilferage, epidemics, quarantines, medical or custom department regulations, defaults, or any other causes beyond our control or any untoward incidents or any such causes whatsoever including any liability or extra expenses sustained by the Clients. Further, the Clients shall be liable for the liability or extra expenses incurred by him / her as a result of the forgoing causes.

Indian Holiday Pvt. Ltd. shall not be responsible and shall not accept any liability towards the Clients or his/her legal representative for any loss of property or damages resulting from death or injuries including loss of services which the Clients may sustain on account of act, negligence or default by any transportation Company, hotel agents or any other body of persons, its agents or service providers providing such services or facilities or arising out of or while engaged in any tour, means of transportation or other services, whether due to ownership, maintenance , use, operation or control of any automobile, bicycle, boat, motor, or other vehicle in common carrier or otherwise and whether due to its or there negligence or otherwise or regardless of how caused. Clients using sporting equipment, bicycles, sailing boats, scuba diving gear, hired or supplied by hotels or rental bodies shall do so at their own risk.

Indian Holiday Pvt. Ltd. do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country. All baggage & personal property/s at all times are at the client's risk.

Indian Holiday Pvt. Ltd. reserves the right to cancel any services in case it deems that the tour, trip or passage is impracticable for any reason or should circumstances warrant such action, upon refunding the value thereof and the Client shall not have any other or further claim against the company by any reason thereof.

Indian Holiday Pvt. Ltd. reserves the right to refuse to carry out its contract with any person whom it may consider to be undesirable in its absolute discretion and it shall not be required to show any reason for doing so.

All disputes arising in connection with this Agreement shall be referred to an Arbitrator to be appointed by Indian Holiday Pvt. Ltd. All such disputes shall be subject to the jurisdiction of Delhi (India) Courts only. The laws of India shall govern the validity, interpretation, construction, performance and enforcement of these terms and conditions.

Terms & Conditions for Outbound Tour

All correspondence(s) in respect of Tours / Travel Services and bookings should be addressed to M/s. Indian Holiday Pvt. Ltd.

Booking & Payments

  1. Booking will be accepted for reservation at least minimum of 7 working days prior to the first check-in-date. Should the booking be required for the check in within 5 working days then a deposit for 01 night stay or Rs 10000 which ever is more is required. (during high season full payment required to secure the reservation). In some cases we might require upto 100% payment in advance.
  2. Whilst making the booking all accurate details are required.
  3. No amendments allowed after commencement of travel.
  4. All booking must be made on pre-payment basis (i.e. must be paid in full in India before the passengers departure & in foreign currency as indicated in the manual & adhering to the RBI guidelines/rules/circulars issued by the concerned authorities & also include provisions of FEMA 1999.
  5. Payments in INR/Foreign currency must be accompanied by the original passport & tickets of all the passengers traveling.
  6. All rates are subject to a revision if there is a fluctuation in the currency rates.
  7. All rates, terms & conditions are subject to change without notice.
  8. There could be variation of policies for the booking/reservations made by the hotel management during the peak season/ trade fair/New Year/ Christmas Eve, Public holidays etc.
  9. Passenger need to return the duly complete printed booking form singed along with an initial deposit of Rs. 10000 in order to confirm his reservation.

Cancellation Policy

Should you be forced to amend/cancel the confirmed booking you must fill and sign the amendment/cancellation advice which will entail cancelling your particular reservation, thereby the cancellation charges apply. Should you wish to cancel any part of a confirmed booking/reservation all such cancellation must be advised in writing. Given below is the cancellations policy.

Cancellation charges per person:
  • 21 days prior to the departure of the tour 10% of the total tour cost.
  • 20-15 days prior to the departure of the tour 50% of the total tour cost.
  • 14-8 days prior to the departure of the tour 70% of the total tour cost.
  • 7 days or less prior to the departure for the tour or a 'No Show', 100% of the total tour cost.
  • Cancellations / Amendments, made whilst on tour, 100% of the total tour cost.
Refunds
  • Refunds will be made only in India in INR only as per RBI regulations.
  • Refunds (if any) for amendment and/or cancellation will be paid directly or by the preferred sales agent through whom you have forwarded the booking to us.
  • It would take at least 30 days to process the refunds and there is no refund payable for any unutilized services (E. g: meals/entrance fees/sightseeing etc.)
  • There will be refund for cancellation of reservation after commencement of travel.
Not Included in the Tour Cost

The cost of gratuities, insurance sightseeing, excess baggage charges, laundry, drinks, tips, airport taxes, meals except where indicated and items of personal nature are not included in the tour cost.

High Season / Trade Fairs / Festivals

Special conditions shall apply for booking high season/trade fairs/festival which will be advised at the time of booking.

Scope of Activity

We are travel and holiday organizers only. We do not control or operate any airline, neither do we own or control any shipping company, coach or coach company, hotel transporter or any other facility as mentioned in the manual. We take care in selecting all ingredients in a clients holiday, But because we only select and inspect them and have no control in running of them, we cannot be held responsible for any injury, death, loss or damage which is caused by the act or default of the management or employees of any hoteliers, airlines, shipping companies, coach owners/coach operators who are the company's independent contractors arising outside our normal selection and in special process.

Hotel Check In and Check Out Timings

Normally the check in is 1400 hrs at all hotels worldwide and the check out time is 1200hrs. Early check in and late check out is always subject to availability at the hotel and can never be guaranteed under any circumstances. Should the clients be arriving early in the morning and be requiring the room on his/her arrival, the room confirmation must be requested for the previous night.

Other Terms

  1. 'Client' means the personal/persons in whose name or on whose behalf the booking is made.
  2. 'Company' means Indian Holiday Pvt. Ltd.
  3. Independent contractors means "Hotelier/Hotel Owners", Owner of any airline or shipping company or railway, ferry boat owner/operator/coach owner/or any other person who has been selected by the company to render service to the client. No person other than the company, in writing, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition.
  4. The company shall in no circumstances, whatsoever, be liable to the clients for: Any death, personal injury, sickness accident, loss, delay, discomfort, increased expenses, consequential loss and / or damage or nay misadventure however caused.

    Any act, omission, default or independent contractor or other person or nay servant or Agent employed by them who maybe engaged or concerned in the provision of accommodation, refreshment, carriage facilities or services for the client or for any other person travelling with him howsoever caused.

    The temporary or permanent loss or damage to baggage or personal effects howsoever caused in this condition the expression "howsoever caused" includes negligence on the part of any person.
  5. No liability on part of the company arising in any way out of this contract in respect of any tour, holiday, and excursion facility, shall expect the total amount paid or agreed to be paid for the holiday and shall in no case include any consequential loss or additional expense whatsoever.
  6. If the clients has any complaint in respect of the service provided any of the Independent Contractors, the client shall immediately notify the same in writing to the independent contractor and with a copy to IHPL Office where the booking had been made on his return. This will enable our company to take up the matter with the independent Contractor so that in future other clients do not face any difficulty.
  7. Each of these conditions shall be severable from the other. If any provision where invalid, illegal or unenforceable then the remaining provision shall nevertheless have full force and effect.
  8. The foreign exchange payments are subject to RBI/GOI rules & regulations.
  9. Tips are mandatory in Europe.
